Below are registration processes in Malaysia:

  1. Trademark Search:
    • Begin by conducting a comprehensive trademark search through MyIPO to determine if your desired mark is already registered or similar to existing trademarks.
    • This search helps ensure your trademark complies with the Malaysian Trade Marks Act 2019.
    • Search results are typically available within 2-3 business days.
  2. Application Submission:
    • Once the search is complete, prepare and submit your trademark application to MyIPO.
    • This process usually takes 2-3 business days to complete.
    • You will receive a filing document and receipt via email as proof of your application.
    • The official examination of your application by MyIPO may take 6 to 12 months.
    • Upon successful examination, you will receive a notice of acceptance.
  3. Gazette Publication & Registration:
    • After receiving the notice of acceptance, your trademark will be advertised in the government gazette for a two-month period.
    • If no third party opposes your trademark registration within this time, your trademark will be officially registered.
    • You will receive a notification of registration.
    • A hard copy of the registration certificate can be obtained by requesting it and paying an additional fee.

Timeline:

  • The entire registration process typically takes 8 to 14 months for straightforward applications.

Trademark Validity:

  • Each trademark registration is valid for 10 years and can be renewed every 10 years.
